The Supreme Court of British Columbia just granted aboriginal title over hundreds of acres of fee simple land in Richmond.
This alarming precedent undermines property rights across all of British Columbia.
The ruling in Cowichan Tribes v. Canada stated “The question of what remains of Aboriginal title after the granting of fee simple title to the same lands should be reversed. The proper question is: what remains of fee simple title after Aboriginal title is recognized in the same lands?”
B.C.’s Attorney General Niki Sharma won't even tell us if the government plans to appeal.
